Terms and Conditions of UNEW Beauty Couture AG for BIO SCULPTURE SWITZERLAND.
1. Scope and provider
These Terms and Conditions apply to website-related offers, information, professional services and activities of BIO SCULPTURE SWITZERLAND within their scope.
The provider and contractual partner for services covered by these Terms is UNEW Beauty Couture AG, Sinserstrasse 8, 6330 Cham, Switzerland, a Swiss corporation. No separate German or Austrian contracting companies exist unless a specific offer expressly names another party.
2. Relationship with online-shop terms
BIO Sculpture products and training are offered through the responsible online shops. The terms published in the relevant shop govern the specific purchase or booking.
Where these framework Terms and the relevant shop terms regulate the same transaction-specific matter, the shop terms prevail. This includes prices, VAT, contract formation, payment, training cancellation, rebooking and no-show, delivery, shipping, returns, exchange, warranty and other purchase- or booking-related conditions.
The same applies to telephone, email or other communication-based orders and bookings where they relate to a shop offer and the shop terms are incorporated.
3. Products and training
Website information about products and training is for guidance and is not a binding offer unless expressly stated. Availability, content, requirements and details may change; errors and technical inaccuracies remain reserved where legally permitted.
Training may require prior knowledge or qualifications and UNEW may request evidence where objectively necessary. Transaction-specific conditions follow the responsible shop terms.
4. Professional responsibility and application
Users are responsible for professional and lawful application of the techniques, products and systems. Training and information do not replace an independent professional assessment or verification of local legal, regulatory, hygiene, safety and occupational requirements. Manufacturer instructions, safety information, labelling and application requirements must be followed.
5. Training results, certificates and no success guarantee
Certification requires fulfilment of the relevant training requirements. A certificate confirms participation or performance but does not guarantee legal or regulatory authorisation to practise.
To the extent legally permitted, UNEW guarantees neither a particular treatment result nor commercial success, customer numbers, revenue, professional admission, third-party recognition or success in self-employment.
6. Digital content, training material and credentials
Access is personal unless otherwise agreed. Credentials must not be shared or made available to unauthorised third parties. Without permission, digital content and training material may not be copied, published, distributed, resold, used for unauthorised training or made accessible to third parties. Transaction-specific shop terms remain reserved.
7. Trademark, copyright and usage rights
Trademarks, logos, images, texts, videos, course materials, concepts, training systems and other protected content may be used only within granted rights. This applies where UNEW owns or may exercise the rights; the rights of brand owners and other rights holders remain reserved. Participation, access or purchase transfers no trademark, copyright, distribution, training or licence rights.
8. Website, external offers and liability
UNEW does not guarantee permanent uninterrupted availability, completeness, currency or suitability for a specific individual purpose. External websites and shops are responsible for their own content, availability and services.
UNEW liability is limited to the greatest extent permitted by applicable law. Liability for intent and gross negligence remains. Where permitted, liability for slight negligence, indirect or consequential loss, lost profit or revenue, business interruption, reputational damage and other economic loss is excluded.
Where legally permitted, UNEW is not liable for damage or results caused by improper application, disregard of manufacturer instructions, insufficient qualification, individual customer reactions or breaches of usersโ own professional or legal duties. Mandatory statutory liability remains unaffected.
9. Privacy
Information about processing personal data is provided in the Privacy Policy.
10. Swiss law, jurisdiction, authoritative version and final provisions
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), where legally permitted.
The place of jurisdiction is Zug, Switzerland, unless mandatory law requires another forum. Mandatory provisions applicable irrespective of the choice of law remain reserved. If a provision is invalid, the remaining provisions remain effective to the extent legally permitted.
The German version is the legally authoritative original. Translations into other languages are for information only. In the event of deviations, differences in interpretation or contradictions, only the German version shall prevail.
